General conditions

Right of withdrawal
You have the right to withdraw your purchase within 14 days of delivery and although we appreciate your feedback you are not obligated to give us a reason for asking for a refund.

Withdrawal on bespoke orders
You can’t withdraw your order on bespoke orders. However, if you cancel in time and the order hasn’t been sent out to our manufacturer, we may be able to cancel your order without charge.

Withdrawal on pre and back orders
Cancellations on pre/back orders of two items or less are reimbursed fully, cancellations on pre/back orders of three or more items may – depending on production status – be subject to a cancellation fee of 20% of the total amount of your order.

Refunds
Refunds will be paid in full within one week, after we receive the product and see there’s no damage to the item. The cost of shipping back items, will be paid for by the customer.

Confirmation of your order
You will receive an automatic confirmation email after you place an order. When your order is processed you will receive another mail with your invoice and a mail with a link to track your order.

VAT
All prices are including 21% VAT. Businesses outside of the Netherlands pay a 0% VAT rate. Before you buy, please make an account and add your Tax nr, so that we can adjust your tax rate during checkout.

Wrong order or shipping damage
Please examine your order immediately upon receipt. If your product does not arrive as ordered, please reach out to us within 5 days of receipt to make sure we can get you the correct item. If you receive a damaged product, please send us your order number and photos – also of the unopened packaging if possible – thoroughly documenting the damage to the item and the packaging.

Warranty
Omsch warrants its products to be free from defects in material and workmanship for a period of two years from the original date of purchase. If you discover a defect in a product covered by this warranty, we will repair at our option using new or refurbished components, or if repair is not possible, replace the item. We reserve the right to request order numbers, receipts, and other supplemental order information as proof of purchase to validate warranty claims. At the time of return, it is possible that we no longer carry the product in its original color or size. In these instances, we will fulfill the warranty with the product’s available color or size selection.

Disputes
Naturally we are assuming we never get into a dispute with any of our customers. But if we do, you can submit any complaints you may have, in writing to the Disputes Committee [Geschillencommissie] within a 
reasonable period after the start of the dispute. The Disputes Committee is acknowledged by both the Dutch Government and the European Commission.

Limited Liability
Should the product(s) fail, your sole recourse shall be repair or replacement, as described under “warranty” We will not be held liable to you or any other party for any damages that result from the failure of this product. Damages excluded include, but are not limited to, the following: lost profits, lost savings, lost data, damage to other equipment, damages arising from installation, and incidental or consequential damages arising from the use, or inability to use this product. In no event will Omsch be liable for more than the amount or your purchase price, not to exceed the current list price of the product, and excluding tax, shipping and handling charges. Omsch disclaims any other warranties, express or implied. By installing or using the product, the user accepts all terms described herein.

Warranty Exclusions
The warranty does not cover loss or theft, nor does coverage extend to damage caused by misuse, abuse, unauthorized modification or improper storage conditions. The warranty does not cover normal wear-and-tear. The warranty does not cover defects that result from exposure to high temperature or high humidity environments or abrasive and aggressive cleaning liquids.

Omsch is committed to protecting your privacy when you visit our website omsch.com Omsch ensures you that the information you provide us with is kept private and confidential, and we will only use it to provide the services you request. Omsch may make changes to this privacy policy, which come into effect upon updating this page. We recommend reviewing this privacy policy so you are aware of any changes that affect what you are consenting to by interacting with the website.This Privacy Policy is effective from 26 March 2019.

Webshop
When you order a product from the Omsch webshop, we need to know your name, billing and shipping addresses, telephone number, email address, and credit card (or other payment method) information to process your order. Your credit card (or other payment method) information will not be stored. Any external partner involved, such as software suppliers and payment providers assigned by Omsch are operating in accordance with GDPR.

Cookies
Omsch.com uses cookies, a common Internet technology to locally store small files on a users’ computer. Cookies are small files of information that are stored on your computer’s hard drive by your Web browser. Cookies are not used for personal identification, only for identification of one’s computer. The cookies we use do not contain any personal information. Most Web browsers automatically accept cookies, but you can change the preferences of your browser so that it does not accept them. In order to use all the features of the Omsch website, we recommend that you accept cookies.

Mailing List
When you sign up to our mailing list, we will ask you to provide us with your email address. You can unsubscribe at any time. The option to do so is linked from every email you receive from us at the bottom of the mail.

Disclaimer

The information we collect
Your personal information is contained behind secured networks and is only accessible by a limited number of persons who have special access rights to such systems, and are required to keep the information confidential. Omsch uses the personal information you provide to us for internal purposes, such as completing and tracking your transaction, analysing trends, and collecting statistics. Omsch may also compile and provide aggregate statistics about our visitors, customers, sales, traffic patterns, and related site information to third parties, but these statistics will not include any personally identifying information.

We protect your information
Omsch takes reasonable and appropriate measures to protect personal information from loss, misuse and unauthorized access, disclosure, alteration and destruction, considering the risks involved in the processing and the nature of the personal information. We are committed to ensure that your information is secure. In order to prevent unauthorised access or disclosure, we have put in place suitable physical, electronic and other procedures to safeguard and secure the information we collect online, through offline forms, sales or on personal request .

All sensitive/credit card information you supply is encrypted via Secure Socket Layer (SSL) technology. All transactions are processed through our payment gateway provider sisow.nl and are not stored or processed on our servers.
